The View From Fort Point
Hi Friends, I was all set to provide some tea on an important, new federal reporting requirement for residential purchases that would likely affect most of us in our future transactions known as FinCEN - Financial Crimes Enforcement Network’s (FinCEN) Residential Real Estate Anti-Money Laundering (AML) Rule. They relate to how we buy and sell homes and the potential money laundering risks associated with all-cash purchases via legal entities or trusts.
When I first learned of this new rule, I was absolutely certain it wouldn’t go into effect on March 1, 2026 given that it centers around financial disclosure and transparency - not something our current administration has proven they are too keen on participating in - and, lo and behold, on March 19, a federal district court in Texas vacated the Rule, holding that the agency exceeded its statutory authority under the Bank Secrecy Act and violated the Administrative Procedure Act.
For now, the rule has been “set aside” and the reporting requirements are no longer subject to liability if they fail to be reported while the order remains in force. That's a small 'win' for most of us who buy and sell homes in Trusts, for now!

The romantic, candle-lit tour, takes place on weekend evenings before daylight savings, so you'll have to wait until November to purchase tickets, but I highly recommend the memorable tour be shared with someone special in your life.
